These Terms and Conditions govern your use of the services provided by BP&IA Holdings Ltd, a company registered in the United Kingdom, which operates under the trading name Pragmat. When we refer to 'Pragmat', 'we', 'us', or 'our', we are referring to BP&IA Holdings Ltd in its capacity as the provider of the Pragmat service. By accessing and using the Pragmat platform, you are entering into a legal agreement with BP&IA Holdings Ltd, acknowledging and consenting to these Terms.

 

Pragmat provides various content and services to its users and registered members, each in accordance with these Terms and the terms of any specific offer, promotion, or usage guidelines that may apply to your use of our platform. In the event of any inconsistency between these Terms and the terms of a specific offer or promotion, the terms of the offer or promotion shall take precedence.

Use of Pragmat by Minors: Age Restrictions and Compliance


Pragmat is expressly designed for and directed to users who are 13 years of age or older. Our services, content, and digital applications are not intended for children under the age of 13. Anyone who signs up to the platform affirms that they are over the age of 13.


In compliance with the UK GDPR and to prevent unauthorised use by children under 13 users may be required to provide their date of birth during registration or at other stages of interaction with our platform.
We may implement additional verification methods, such as confirmation prompts or age verification checks, to ensure users meet the age requirement.


Users are responsible for providing accurate age information. Any misrepresentation of age to bypass our age restrictions is a breach of these Terms. If it is discovered that a user under the age of 13 has provided personal information, we will promptly take steps to remove such information from our records and terminate the user's access to Pragmat, in addition, to further action such as restriction from future use of our services.

Users are reminded of their responsibility to provide accurate and truthful information regarding their age. We reserve the right to undertake any necessary checks to verify the accuracy of the provided age information.


We encourage parents and guardians to monitor their children's online activities and to instruct children never to provide personal information on our platform or any other website without parental permission.


If we inadvertently collect personal information from a child under 13 without verified parental consent, we will take immediate steps to delete that information, with the data typically being deleted in less than a week (although it may take longer depending on the circumstance). Parents or guardians who believe that Pragmat may have inadvertently collected personal data from a child under 13 can submit a request for deletion to support@pragmat.co.uk.


If you are aware of any minor under the age of 13 using Pragmat, please report this to us immediately at support@pragmat.co.uk so we can take appropriate action.


Pragmat may update or modify this age restriction policy periodically to comply with legal and regulatory changes, or to better address user safety and security concerns.

 

Intellectual Property

 

The contents and design of the Site, any Digital Application, and any material provided to you in conjunction with the Site and/or a Digital Application (collectively referred to as "Pragmat Content") are protected by copyright owned by Pragmat and its licensors. Your use of Pragmat Content does not grant you any commercial or promotional use rights in the Pragmat Content. You may not use or reproduce any trademarks (including, but not limited to, "Pragmat" and associated names and logos) appearing on the Site or any Digital Application for any purpose without prior written permission from Pragmat. The software powering the Site and all Digital Applications is proprietary and can only be used as expressly allowed under these Terms. You may not copy, reverse engineer, modify, or otherwise manipulate the software.

 

Use of Pragmat Content

 

All Pragmat Content is intended for personal, non-commercial use only.

You may access and view Pragmat Content on a computer screen or mobile device, print individual pages (but not photocopy them), and store such pages electronically on your computer or mobile device for your personal, non-commercial use. Digital Applications may be used only on devices for which they were intended, for your personal, non-commercial use, and on no more than five separate devices. Except as expressly permitted above, you may not reproduce, modify, or commercially exploit any Pragmat Content. In particular, but without limiting the general application of the restrictions, you may not do any of the following without prior written permission from Pragmat:

 

  • Reproduce, store in or transmit to any other website, newsgroup, mailing list, electronic bulletin board, server, or other storage device connected to a network, or regularly or systematically store in electronic or print form, all or any part of the Pragmat Content.

  • Modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works from, distribute, perform, display, or in any way exploit all or any part of the Pragmat Content.

  • Remove the copyright or trademark notice from any copies of Pragmat Content.

  • Avoid, bypass, or override any paywall on our Sites and Digital Applications, except pursuant to your entitlement as a Registered User.

 

Additionally, you may not use or permit the use of any software, tool, or other device on the Sites, Digital Applications, or Pragmat Content to copy, collect, or scrape data unless specifically authorised. Conducting data mining or applying machine learning tools or models to Pragmat Content is also not permitted.

 

Furthermore, you may not use artificial intelligence tools or models to generate material or derivative works based on or using Pragmat Content, whether or not in a similar style as Pragmat Content, without prior written permission from Pragmat.

 

Registration, Passwords, and Responsibilities

 

Your responsibility is to maintain updated and confidential information, including your password.

 

Certain sections or features of our Sites and Digital Applications are open only to Registered Users or individuals who have agreed to become Recipients.

 

Registering for an account on our Site or Digital Application, makes you a customer of Pragmat, referred to as a "Registered User." Registered Users enjoy specific benefits.

 

By providing your email address on certain Sites or Digital Applications to access benefits, products, or services without becoming a Subscriber or Registered User, you become a "Recipient."

 

You are solely responsible for the confidentiality, use, and access to Pragmat Content, the Site, and/or Digital Applications using your username and/or password. You agree to immediately notify Pragmat if you discover the loss, theft, or unauthorised use of any password, user ID, email address, or Pragmat Content. You will provide Pragmat with accurate and complete registration information and inform Pragmat of any changes to such information. To confirm your compliance with these Terms, Pragmat reserves the right to monitor and record activity on the Site and Digital Applications, including access to Pragmat Content.

 

User-Created Content (Excluding Article Submissions)

 

Pragmat's website and Digital Applications allow users to contribute comments and engage in discussions ("Comments") on various content. You are solely responsible for the content of your Comments. By posting Comments on our platform, you agree to adhere to the following guidelines:

 

1. Respect and Decency: Ensure that your Comments are respectful, free from hate speech, and do not promote racism, sexism, homophobia, or any form of discrimination. Maintain a respectful and considerate tone in your interactions with other users.

2. Copyright and Originality: Do not post Comments that infringe upon copyright or contain material taken from other sources without appropriate attribution. Your Comments should be your original work.

3. Legality and Defamation: Avoid posting Comments that are illegal, libelous, defamatory, or might interfere with ongoing legal proceedings or court orders.

4. Abusive or Threatening Language: Refrain from using abusive or threatening language in your Comments. Personal attacks against other users or Pragmat's staff are strictly prohibited.

5. Relevance: Ensure that your Comments are relevant to the content and the topic under discussion.

6. Advertising and Spam: Do not use Comments for advertising, promotional purposes, or to share chain messages or spam.

7. Financial Recommendations: Do not provide financial recommendations in your Comments or share confidential information about others. Avoid attempting to influence the price or value of any security through your Comments.

8. Impersonation: Do not impersonate other individuals or entities, including Pragmat employees, Forum guests, or hosts.

9. Malicious Software: Do not post Comments that contain software viruses, files, or code intended to disrupt or harm the functionality of the website, digital applications, or any computer software or equipment.

10. Inhibition of Use: Do not restrict or inhibit other users from using the Comment section.

 

By submitting Comments, you grant Pragmat the right to display and use them in connection with the relevant content. Pragmat may contact you regarding your Comments and reserves the right to moderate, edit, or delete any Comments that do not comply with these guidelines.

 

Your use of the Comment section constitutes your agreement to indemnify and hold Pragmat harmless from any claims, costs, and expenses arising from your non-compliance with these guidelines and any associated legal issues.

 

Article Submission

When you submit an article to Pragmat, it's crucial to understand the terms related to intellectual property and liability. Firstly, as the author, you retain the full intellectual property rights to your articles. This ownership implies that you are solely responsible for the content of your submissions. You must ensure that your articles are original and do not infringe upon the intellectual property rights of any third party.

By submitting your article to Pragmat, you grant us a non-exclusive license. This license allows Pragmat to use, display, publish, distribute, and record your article in audio format for dissemination on platforms such as Spotify and other audio distribution services, as well as in related promotional activities. However, it's important to note that this does not mean we take ownership of your work. You continue to hold the intellectual property rights. Additionally, we will ensure that you are properly credited as the author in all formats where your article is used.

If you do not wish for your article to be recorded and shared in audio format, or if you wish for an already published audio version to be removed, please contact us at support@pragmat.co.uk. We will honor such requests and take reasonable steps to comply with your preferences regarding the use of your content in audio format.

Regarding copyright compliance, it is your responsibility to ensure that your articles do not contain material that violates copyright laws and that your submission is entirely your own works. Plagiarism is strictly prohibited and will be treated with the utmost seriousness. In the case you want to use external sources, it is imperative that these are cited appropriately in accordance with our citation policy in our Writing Guide. Should you submit any plagiarised content, as the author, you are responsible for any legal claims or disputes that arise from copyright infringement or other intellectual property rights violations in your articles.

Submissions derived from AI technologies are strictly prohibited and classified under plagiarism. You affirm that your submission is your original work, free from AI-generated content. Violation of this policy will result in non-publication and may lead to further actions consistent with our stance on plagiarism, including possible exclusion from future submissions.

As stated previously, in the case you submit plagiarised content of any form, you provide an indemnification agreeing to protect Pragmat from any claims, liabilities, or legal costs that may arise from the content you submit. This means if a third party makes a claim against Pragmat related to your content, you will be responsible for handling and resolving such claims, including any associated legal costs.

Pragmat reserves the right to remove content from our platform if it violates our submission policies or if we receive a valid claim of copyright infringement. We will act to ensure compliance with legal requirements and the protection of our platform's integrity. However, as the author, you also have the right to request the removal of your article from our platform. When such a request is made, we will take reasonable steps to cease using and remove your content from our site and other channels where it is featured.

By submitting your article to Pragmat, you also grant us the permission to share, promote, and disseminate your content across social media platforms and through various forms of communication for promotional purposes. This includes the right for Pragmat to adapt, modify, or create derivative works based on your article to fit the format or requirements of different promotional channels, always ensuring that your authorship is credited.

This extended permission aims to amplify the reach of your work, engaging a broader audience and increasing visibility for your articles within and beyond the Pragmat community. It is understood that this does not transfer any additional ownership rights to Pragmat and is solely for the purpose of promoting your contributions and Pragmat as a platform.

Your consent to this promotional use is considered part of the non-exclusive license granted to Pragmat upon article submission. Please be assured that our goal in sharing your content is to highlight the valuable insights and perspectives you bring to our platform, fostering a rich dialogue on social sciences topics.

We commit to using your content respectfully and judiciously, in ways that support both your interests as a contributor and Pragmat's mission to democratise access to social sciences knowledge.

If at any time you wish for your article not to be shared or accredited to you on social media, audio platforms, or other promotional channels, please reach out to us directly at support@pragmat.co.uk. We respect our contributors' preferences and will honor requests to limit the use of your content in our promotional efforts. Communication is key to our partnership, and we are committed to ensuring your satisfaction and comfort with how your work is represented and utilised by Pragmat.

Furthermore, you understand that in the case an article submission is deemed to not be up to the standard required, that Pragmat may send you emails to not only inform you, but to also recommend potential avenues to explore that could improve the article so that it would be up to our standard.

Limitation of Liability
 

In using Pragmat's services, you acknowledge that Pragmat, including its directors, employees, agents, or affiliates, shall not be liable for any loss or damage, whether direct, indirect, incidental, consequential, or otherwise, resulting from the use or inability to use the Site, Digital Applications, or Pragmat Content. This includes but is not limited to inaccuracies in content, loss of data, or any interruption of service.

Users expressly acknowledge that Pragmat is not liable for the conduct of third parties, including other users, and that the risk of the Site and Digital Applications rests entirely with you as the user.

If you are dissatisfied with any aspect of our service, or with any of these Terms and Conditions, your sole and exclusive remedy is to discontinue using Pragmat’s services.

The above limitations of liability shall apply to the fullest extent permitted by law in the United Kingdom and do not affect your statutory rights as a consumer.

These terms have been prepared on 01/02/2024. Pragmat reserves the right to amend these terms at any time, without prior notice. It is the responsibility of contributors and users of the Pragmat website to stay informed about any changes to these terms, which may be updated periodically.
